Congressman Issa’s Bill Would First Layoff Retirement Eligible Postal Employees

Congressmen Darrell Issa and Dennis Ross’ amendment to its Postal Reform bill will require USPS to “separate”  all retirement eligible employees prior to laying off any workers not yet eligible for a pension, and to “separate” the most senior of them first:

(II) the term ‘‘non-retirement-eligible employee’’ means an employee who is not a retirement-eligible employee.

(ii) GENERAL RULE.—A reduction in force under this subsection shall not result in the separation of any non-retirement-eligible employee before a retirement-eligible
employee.

(iii) LENGTH OF SERVICE.—In determining the order for the separation of competing retirement-eligible employees, individuals shall be separated in descending order based on length of service.

(E) SEVERANCE PAY.—A retirement-eligible employee who is separated pursuant to a reduction in force under this subsection shall not, by virtue of that separation, be eligible for any  payment in the nature of severance pay.

(F) LIMITATION ON REEMPLOYMENT.—An employee described in subparagraph (D)(i)(I)  who has been separated pursuant to a reduction  in force under this subsection may not be offered reemployment in any position for which any employee, or former employee, of the Postal Service who is described in subparagraph  (D)(i)(II)—
(i) has applied; and
(ii) is qualified and available.
(4) REGULATIONS.—Any regulations necessary  to carry out this subsection shall be prescribed by  the Office of Personnel Management not later than  90 days after the date of the enactment of this Act.

  1. I would love to retire but I can’t afford to right now. I need to wait until I am at least 62 to get social security also. To the people here saying that older workers are slow slackers, I tell you that I can work circles around the younger people in my office. All they do is whine and cry about too much mail. They have no work ethics. Always calling in sick if they have a runny nose. They won’t go the extra mile for customer service.

  2. It use to be employees with 6 years and under were the ones that were RIF 1st.

    Why is that? And why did this change.I smell rat along with union, dont trust either side anymore.

    Tell me why should Issa/Ross and the PMG care who gets RIF as long as its the number of employees they need to reduce?

    So they won’t have to pay higher salaries or benefits? Yes

    Is it discrimination? Yes.

    Does this somehow have something to do with privatization down the road and they need the CSRS employees out of the way? Time will tell.

    A smart proposal? No.. why… if i have to tell you then your just as F up in the head as they are.

  5. It’s a very smart proposal. Everybody yelling discrimination is a joke. By that standard would’nt an incentive offer be a bribe? If you’re retirement elligible you’re probably CSRS and looking at a sweet retirenlment. Unless you spent a whole career whining and crying about the job that has made it possible for you to live your life in a comfortable way.
    As for the union, don’t make me laugh. They will cut a deal just like they always do.

    For the senior employee who does not gainfully employed at all, I agree for the retirement eligible has to go first ,I know some of them will not agree and say I can still work like young employee,but if you really care about the postal service it is time to go now.

    The postal service has been underated and non-competetive than private sector such as ups and fed-ex for a long time.

    And I agree they been so generous with non profit mail which is does not increase any revenue also.

    In addition, they been doing so much such a spending especially exchanging the new machine in uncertain future mail volume reality.

    and the postal upper management has been paid more than 200 k,some of them gets paid more than a president obama.

Between all 3 tours there is approximately 15 people who walk through the turnstiles with canes. These people can barely wipe their own asses let alone climb catwalks or ladders. I asked one of the old timers (76 year old MPE) why he don’t just retire. He said ” why would I retire and get 80 percent of my pay when I can come here and do nothing and get 100 pct “.   23. I would like to retire when I am 66 but I am being sure what effect Obama’s health bills will have on premiums. Ohio will see an 85% in their health premiums due to Obama’s health plan. If we go to 5 day work week. rural carriers will have to put in for vac. at beginning of the year with no assurance that they will be able to get off when they want. If you are sick who will cover for you if we get rid of our rca’s.And the idiot who thinks whitey’s are all republicans. I vote for the best person for the job not what party he or she belongs to. Eligible employees should retire to avoid layoffs as the need for present manpower no longer exist or will ever gain any momentumn in the 21st century. USPS present status is comparable to using a smoke signal in the 20th century or bthe INTERNET in the 21st century.

  37. A heavy-handed draconian bill, even by Republican standards. According to the OPM handbook, an RIF entitles a qualified individual to severance pay. Then Issa’s bill comes along and negates that part? I understand that in his mind that person is eligible for retirement and doesn’t need the severance pay, but on the other hand the post office is forcing them out so they are entitled to it since some are still willing and able to work. This is beginning to feel very sci-fi. Older people being displaced and/or put down to make room for the next generation, rights bedamned. How very business-like.

    From age 53 to approximately age 57 I have been presented with 2 fit for duty exams, a back to work agreement I felt I needed to sign regarding a junior employee, ( however I consider coercion, ) & 3 suspension letters. Does harassment enter into this category here? 2 suspension letters were overturned by arbitration, the 3rd was reduced to a letter of warning, & now gone. The worst part of a persons work life is at the very end, & now this employer is facing possible default & bankruptcy? What lucky sign was I born under? Issa bill is certainly age discrimination & smells of union busting.
