LEAGUE Office Receives Proposal to Revise Salary Protection Provisions in the ELM

On January 28, 2011 the LEAGUE office received a letter from John Cavallo, Manager Labor Relations regarding a proposed change to the salary protection provisions in Employee and Labor Relations Manual (ELM) Section 415, Rate Retention and Change to Lower EAS Grade. The main change impacting EAS is that those Postmasters/EAS that had salary protection when changed to a lower nonbargaining grade during a Reduction in Force (RIF) avoidance period, a specific RIF notice period, placement in a nonduty, nonpay status for 30 days related to RIF, or to a RIF will not extend beyond two years of saved grade unless the protected salary is below the maximum of the employee’s new grade. If the employee’s salary exceeds the maximum of the new grade upon expiration of the two years of protection is provided in ELM 415, it will be reduced immediately to the maximum of the new grade.

Simply put, the indefinite saved salary would be removed from the ELM. The LEAGUE of Postmasters is adamantly opposed to this revision. Mark Strong, President of the LEAGUE has requested a meeting with PMG Pat Donahoe with regard to these revisions. We are very disappointed that after months of working on DUO and specially addressing RIF in which we were assured that no Postmasters salary would be impacted that less than 30 days later this change has been proposed.

Pursuant to Title 39, U.S. Code, Section 1004 (d) we have 60 days to respond with our recommendations. We will keep all Postmasters informed of the results from the requested meeting with PMG Donahoe and any changes that take place with regard to this proposal to revise Section 415 of the ELM.

Proposed ELM Revision (Section 415)

On Friday, January 28, 2011, NAPUS President Bob Rapoza received a letter from USPS Acting Manager, Labor Relations Policy Administration, notifying NAPUS of a proposed revision of the salary protection provisions of the Employee and Labor Relations Manual (ELM) Section 415, Rate Retention and Change to Lower EAS Grade.The proposed changes to ELM Section 415 include the following;

  • Salary protection related to a change to a lower non-bargaining grade during a Reduction-in-Force (RIF) avoidance period, a specific RIF notice period, placement in a non-duty, non-pay status for 30 days related to a RIF, or to a RIF will not extend beyond two years of saved grade, unless the protected salary is below the maximum of the employee’s new grade.  If the employee’s salary exceeds the maximum of the new grade upon expiration of the two years of protection provided in ELM 415, it will be reduced immediately to the maximum of the new grade.
  • When an employee voluntarily accepts a lower grade non-bargaining unit position in a management initiated action, the employee will receive saved-salary protection for two years. If the employee’s salary at the end of this period is greater than the maximum salary of the lower grade position, the salary will be reduced immediately to the maximum of the lower grade position.
  • If a position is reclassified to a lower grade, the employee is reduced immediately to the lower grade.  The employee receives saved salary for a period not to exceed two years, if the employee’s salary at the end of this period is greater than the maximum salary of the lower grade position, the salary will be reduced immediately to the maximum of the lower grade position.

In response to the proposed revision of the salary protection provisions in ELM Section 415, President Rapoza immediately requested a meeting with Postmaster General Pat Donahoe to discuss exempting Postmasters who may be downgraded as a result of the DUO process.  He will remind the PMG that earlier discussions with Postal Service officials included an agreement and written guidelines where NAPUS was assured that the two year saved grade period would be followed by two years of indefinite saved salary for Postmasters who were downgraded as a result of the DUO process.

  1. get rid of them no need for a Postmaster, Station Manager, Clerk Supervisor, 2 Carrier Supervisors, thats just my office where if our 2 204b’s don’t take care of the office, it chaos, these people are stupid, they have been in these spots for sooo long they actually believe they know what they are doing….. All the money,, bonuses WASTE

  2. How can any hard working employee, regardless of being craft or management, use the two words WORK and UNION in the same sentence? Were it not for outragious union benefits, preventing us from removing dead wood, including management, we would be a leaner organization.

  4. I would like to see all EAS employees put on time valued contracts. When the contract ends, a management representative and a union representative would evaluate the candidate’s performance and the position’s viability to see if it the contract should be extended. If not, then open the position for bid, which would include a public offering. If the management and union representatives could not reach a conclusion, then have a public representative join the panel with a majority consensus prevailing. This would eliminate bad managers and unnecessary positions. Everybody wins!

  5. Obviously some of you dont understand who this is affecting. It is Postmasters in small offices who are doing the sorting, culling and handling of the mail. Not craft employees.

Ha, about time.. how about letting the ones ready to retire have the VER and let all the useless postmasters and supervisorsthat will not have a position get moved back to carrying mail, since they know how to do it so effeciently( or so they tell us all the time in service talks)let them remember everything they write us up for!!

    This is better known as save grade, if a managers rate is reduced because his worthless staff is reduced due to Postal woes. He retains his salary for two years and is guaranteed a position at his regular rate if one comes up.
    This proposal eliminates that.
    It’s like you’re job being eliminated, your offered a job as a custodian but continue getting clerk pay. This drops you to custodian pay right away.

  12. hey, guys, it’s merely a proposal at this point. this would be one way to get rid of excess eas who may be hanging on with no plans to retire. they’ll have at least another 2 years plus whatever time it takes to hammer this out if ultimately passed. it will undoubtedly be a whole lot better than what we’ll get. you can bet on that

    in addition, the bounus money was based on inflated or phony numbers…..PO accounting reminds me of Enron! bring in a private sector big 10 accounting firm to do a complete audit of this agency…from top to bottom.

  15. The Postmaster is an outdated position. Get rid of all the postmaster positions and have 1 deputy district manger manage all the post offices in the district. Assign station managers at lesser grades at each post office.

  17. Its only fair. How do you justify their salaries? It is craft who handles the mail, processes it, knows where it goes, how it gets there, preps it and moves it out. The only thing we dont know is where they keep those darned district newsletters. Where to file the stand up talk hand outs, and codes to use on the computer to change comp time….did I leave anything out? Hey, we all know the APWU is still negotiating our contract, and chances are we are not going to “get it all” But if we’re to make concessions, why wouldn’t everyone?
