I have two questions for which I am having difficulty in getting appropriate answers: I was employed for over 23 yrs. as an EAS-14 Mail Flow Controller at the (former) Pittsburgh Bulk Mail Center. In an attempt to appeal an adverse employment action to the MSPB, I was informed by them that they do not have jurisdiction in my case because I was not a management/supervisory employee at the time of my (forced) disability retirement. Is this in fact correct? The other question concerns whether or not I meet the criteria to be included in the NRP Class Action Lawsuit: McConnell v. U.S. Postal Service, EEOC Case No.: 520-2008-00053X. Does the answer to the first question have any bearing on the answer to the second? Also, in 2006 I filed a claim for an occupational disease injury; it has been denied and appealed several times; currently I am awaiting a decision from ECAB. It has not been established with finality whether or not my injury is work-related. I was a member of NAPS from the time I was promoted to an EAS-14 Mail Flow Controller until I was forced to take a disability retirement in order to establish an income. Any information, assistance, or direction you can provide would be greatly appreciated. Thank you.
