USPS: Changes to the Rehabilitation Act

Effective January 1, 2009, the definition of an individual with a “disability” as defined under both the Rehabilitation Act and the Americans with Disabilities Act (ADA) will be significantly expanded. This is due to the passage of the ADA Amendments Act (ADAAA) that sets new standards for determining disability status. Managers, supervisors and the Reasonable Accommodation Committees (RACs) need to be aware of the extent of the changes in the ADAAA so they can assess requests for reasonable accommodation in accordance with these new standards.

Although the Equal Employment Opportunity Commission (EEOC) will issue regulations implementing these new provisions, the regulations will not be published by January 1.Nonetheless, employers must still comply with the law. Consequently, we are providing you with the attached synopsis of the changes in the law so that you are fully informed about the new standards and for use as a guide in making reasonable accommodation decisions.

  4. This is the USPS’s synopsis and analysis. What postal individual wrote this it doesn’t say.
    I quote the paragraph in partial, “…At the very least, this ensures that employees will not bring claims of discrimination based upon a broken leg or a case of the flu..”
    A broken leg may fall under a temporary disabilty. So, now we will have the PO telling employee’s that break anything at work, abled.

    “the flu”??? get real!!!!! The flu has never been considered a disability!!! It’s a sickness. And an employee with the flu, can’t ask for accomadation, becuase it would be the rare occasion of a “direct threat”. It’s contagious. Employee’s may call in sick with the flu. What postal employee has ever had to fight to work with the flu, they are ordered to work with the flu.!!!! Get the real changes.

  6. I have 3 civil suits against the Postal Service over discrimination of my disability. I have lost over 60% usage of my right arm – the Postal Doctor will not let me do anything with it during work hours; however, the post office will not allow me to bid out of carrier craft – instead they gave me a permanent assignment to work 2 hours and sit in a break room 6 hours a day – doing nothing!! However, during the EEO complaint – the Postal Service denied me being regarded as disabled!! This isnt going to change anything the Postal managers do – they dont even regard the National Agreement as a rule; so, how does this little change keep managers in line on how to treat their employees? Get real people! Unless employees and the unions take the Postal Service to court and in front of the media to show the abuse and harassment given to its employees – well, then nothing will ever change!
